Welcome to Apex. These Terms of Use (“Terms”) govern your access to and use of the Apex mobile application, website, and related services (collectively, the “Services”) provided by WHISKER FOUNDATION LLC (“Apex,” “Company,” “we,” “us,” or “our”).
Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Services.
1. Overview of the Services
Apex is a smart money address discovery and follow application. The Services allow users to browse public address lists, view address profiles, review historical performance indicators, and follow selected addresses in a personal watchlist.
Apex is designed for informational, analytical, and research purposes only. Apex does not provide asset custody, wallet services, transfers, order execution, brokerage services, investment advisory services, or personalized financial advice.
2. Informational Purposes Only
All content, data, rankings, charts, indicators, address profiles, historical performance information, and other materials displayed through the Services are provided for informational and research purposes only.
Nothing in the Services should be interpreted as:
- investment, financial, legal, tax, or professional advice;
- a recommendation to buy, sell, hold, follow, copy, or take any action regarding any asset, address, strategy, or activity;
- a guarantee of accuracy, performance, outcome, profit, or future result;
- an offer, solicitation, or invitation to enter into any transaction.
You are solely responsible for your own decisions, research, and risk assessment. Historical performance does not guarantee future results.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.
By using the Services, you represent and warrant that:
- you have the legal capacity to agree to these Terms;
- your use of the Services complies with all applicable laws and regulations;
- you are not prohibited from using the Services under applicable sanctions, export control, or other legal restrictions;
- you will not use the Services for any unlawful, fraudulent, abusive, or harmful purpose.
We may restrict, suspend, or terminate access to the Services if we determine that your use may violate these Terms, applicable law, or create risk for Apex or other users.
4. Accounts and Sign in with Apple
Certain features, such as saving or syncing your watchlist, may require an account. Apex may support account creation and authentication through Sign in with Apple.
When you create or use an account, you agree to provide accurate and current information. You are responsible for maintaining the security of your account and for all activity that occurs under your account.
Apex will never ask you for private keys, seed phrases, wallet passwords, or any credentials that control assets. You should never share such sensitive information with anyone.

5. Watchlist and Follow Features
The Services may allow you to follow or save public addresses to a personal watchlist.
Following an address only means that you have chosen to monitor or save that address within the Services. It does not mean that Apex endorses, recommends, verifies, sponsors, or has any relationship with that address or any activity associated with it.
You are solely responsible for how you interpret and use any information displayed in relation to followed addresses.
6. Data and Accuracy
Apex may display data derived from public sources, third-party data providers, internal calculations, or a combination of these sources.
We strive to provide useful and reliable information, but we do not guarantee that any data, content, indicator, chart, ranking, calculation, or address profile is accurate, complete, current, uninterrupted, or error-free.
Data may be delayed, incomplete, unavailable, inaccurate, or affected by third-party systems. You should independently verify any information before relying on it.
7. No Custody, No Transactions, No Execution
Apex does not hold, custody, transfer, manage, or control user assets.
Apex does not execute orders, route transactions, process payments, or provide any mechanism for buying, selling, swapping, transferring, depositing, or withdrawing assets.
The Services are limited to address discovery, address analytics, address profiles, watchlist functionality, settings, and account-related features.
8. User Conduct
You agree not to:
- use the Services for any illegal, fraudulent, deceptive, abusive, or harmful purpose;
- interfere with, disrupt, or compromise the security or operation of the Services;
- access or attempt to access non-public areas of the Services or related systems;
- scrape, crawl, harvest, or collect data from the Services through automated means without our prior written permission;
- reverse engineer, decompile, modify, or create derivative works based on the Services;
- impersonate any person or entity or misrepresent your affiliation with any person or entity;
- use the Services to infringe, violate, or misappropriate the rights of others;
- upload, transmit, or distribute malware, harmful code, spam, or unauthorized advertising;
- use the Services in a manner that could damage Apex, other users, or third parties.
We reserve the right to investigate and take appropriate action against any violation of these Terms.
9. Intellectual Property
The Services, including software, design, interface, text, graphics, logos, trademarks, data presentation, and other content, are owned by Apex or its licensors and are protected by intellectual property and other laws.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Services for personal, non-commercial purposes.
You may not copy, reproduce, distribute, sell, lease, modify, publicly display, or exploit any part of the Services without our prior written permission.
10. Third-Party Services and Content
The Services may include or rely on third-party data, links, tools, infrastructure, or services. Third-party services are governed by their own terms and policies.
Apex does not control and is not responsible for third-party services, content, data accuracy, availability, security, or practices. Your use of third-party services is at your own risk.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information.

12. Account Deletion
If you create an account, you may request deletion of your account through the account or settings area of the Services, or by contacting us at business@apexliquid.com.
Deleting your account will remove your account record and associated personal data from our active systems, unless we are required or permitted to retain certain information for legal, security, fraud prevention, dispute resolution, or compliance purposes.
If your account was created using Sign in with Apple, we may take steps to revoke or disconnect the relevant authentication token as part of the account deletion process, where applicable.
13. Service Availability and Changes
We may update, modify, suspend, or discontinue all or part of the Services at any time. We may also impose limits on certain features or restrict access to parts of the Services.
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis.
Apex disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
We do not warrant that:
- the Services will meet your expectations;
- the Services will be uninterrupted, secure, or error-free;
- any data or content will be accurate, complete, or current;
- any historical performance indicator will predict future results;
- any address, ranking, or profile is suitable for your purposes.
15. Limitation of Liability
To the maximum extent permitted by law, Apex and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, or losses related to decisions made based on information displayed through the Services.
To the maximum extent permitted by law, Apex’s total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:
- the amount you paid to Apex for the Services in the twelve months before the claim arose; or
- USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless Apex and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use or misuse of the Services;
- your violation of these Terms;
- your violation of applicable laws or regulations;
- your infringement or violation of any rights of another person or entity;
- any decision, action, or reliance based on information obtained through the Services.
17. Termination
We may suspend or terminate your access to the Services at any time if we believe that:
- you violated these Terms;
- your use creates legal, security, operational, or reputational risk;
- we are required to do so by law;
- continued access may harm Apex, users, or third parties.
You may stop using the Services at any time. Certain provisions of these Terms will survive termination, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may notify you through the Services or by other reasonable means.
The “Last Updated” date at the top of these Terms indicates when the Terms were last revised. Your continued use of the Services after the updated Terms become effective means that you accept the updated Terms.
19. Governing Law
These Terms are governed by the laws of [Governing Jurisdiction], without regard to conflict of law principles.
If you are a consumer located in a jurisdiction where local law provides mandatory consumer protections, nothing in these Terms limits any rights you may have under those laws.
20. Dispute Resolution

If a dispute cannot be resolved informally, the dispute will be resolved in the courts or dispute resolution forum specified by the laws of [Governing Jurisdiction], unless applicable law requires otherwise.
21. Apple App Store Terms
If you download or use the Services through the Apple App Store, you acknowledge and agree that:
- these Terms are between you and Apex, not Apple;
- Apple is not responsible for the Services or their content;
- Apple has no obligation to provide maintenance or support services for the Services;
- Apple is not responsible for any claims relating to the Services, including product liability claims, legal compliance claims, or intellectual property claims;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
